1. SUMMARY OF TERMS AND CONDITIONS
a. A 60 minute activity includes briefing and fitting of equipment. Due to the varying ages and abilities of the participants Aerial Adventures can only guarantee one ‘go’ on each activity
b.Lateness, if you are late we won’t wait. Please be at Aerial Adventures 5 minutes before your start time
c. We ask all parents and guardians of children under 12 years to stay on site
d. You have given permission for your child to leave Aerial Adventures at the end of the activity.
2. GENERAL ISSUES
a. These Booking Terms and Conditions apply to the booking of Climbing Walls (the ‘Activities”) and any ancillary products at the location set out in Aerial Adventures booking confirmation.
b. These Booking Terms and Conditions contain important information concerning participation by you and members of your party and, accordingly, you acknowledge and agree that you shall ensure that all members of your party are aware of and accept these Booking Terms and Conditions.
c. No variation to these Booking Terms and Conditions shall be binding unless agreed in writing by Aerial Adventures.
d. Any typographical clerical or other error or omission in any booking confirmation or other documentation issued by Aerial Adventures (including any electronic documentation) shall be subject to correction without any liability on the part of Aerial Adventures.
e. Aerial Adventures reserves the right to make changes to the Activities whether to conform with any applicable safety or other statutory requirements or otherwise.
3. SERVICE LEVEL AGREEMENT
a. Activity session times includes time for ‘kitting’ up and removal of harness etc at the end of the session.

4. CHILDREN UNDER 12 YEARS
a. We ask all parents and guardians of children under 12 years to be aware of the finishing times and remain in the area.
5. BOOKING CONFIRMATION
a. No booking shall be deemed to have been accepted unless accepted in writing by Aerial Adventures (which shall include Aerial Adventures email confirmation of booking).
b. These Booking Terms and Conditions incorporate Aerial Adventuress Privacy Policy, and Risk Acknowledgement and Disclaimer. You and each member of your party will be required to sign the Risk Acknowledgement and Disclaimer before being allowed to undertake the Activities.
c. You must advise Aerial Adventures as soon as possible of any mistake in booking confirmation. Aerial Adventures shall use its reasonable endeavours to ensure that you and your party’s participation commences at the time booked and it shall be the responsibility of each participant to ensure that they arrive in sufficient time. Late arrivals may not be permitted to undertake the Activities and no refunds or compensation will be payable in such circumstances.
6. SAFETY
a. The Activities comprise a challenging high ropes course and participation is not without risk as a fall could be fatal. All participants will receive detailed safety training from an instructor.
b. Aerial Adventures reserves the right to refuse admittance to the Activities or to remove a participant from the Activities should it deem it necessary to do so. This includes a participant who does not comply with the safety rules and advice and the safety system or who is deemed to be under the influence of alcohol or drugs.
c. All participants must be reasonably fit and healthy and must meet these requirements:

d. Anyone who does not meet these requirements will not be allowed to undertake the Activities. It is your responsibility to ensure that all members of your party meet these requirements.
e. All participants are required to wear a safety harness provided by Aerial Adventures and fitted by an instructor. Larger or smaller framed participants may be required to wear an additional chest harness for safety reasons.
f. The Activities are physically demanding and require a degree of agility, strength and stamina. If participants are in any doubt as to whether they should attempt the Activities they are advised to consult their doctor before booking. If participants have medical concerns they are advised to consult their doctor in advance. Participants will be required to certify that they do not suffer from any medical condition which would make it more likely that they would be involved in any incident which could result in injury to themselves or others. Due to the physical nature of the activities, Aerial Adventures® recommends that pregnant women should not take part. Pregnant women who still wish to undertake the activities will be required to sign a disclaimer confirming that they are aware that there are risks to them and to their unborn child and that participation in the activities is at their own risk. (see Risk Acknowledgement and Disclaimer).
g. All participants are required to act responsibly and courteously at all times and to respect other participants. Aerial Adventures shall be entitled to prevent any person from undertaking or completing the Activities in the event it deems the behaviour of any participant unsuitable.
h. Participants must be dressed appropriately (see clause 4) and Aerial Adventures reserves the right to refuse admittance to the Activities to any participant who is not appropriately dressed.
i. No refunds or compensation will be payable by Aerial Adventures in the event that any participant is not permitted to, or decides not to, undertake or complete the Activities for the reasons set out in this clause.

7. CLOTHING
a. It shall be the responsibility of all participants to ensure that they are dressed appropriately. In particular the following restrictions shall apply:
Participants may not undertake the Activities in open -toed or slip-off shoes
Long hair must be tied back
Waists must be covered and piercings removed or taped over for comfort.
Aerial Adventures will not be responsible for any damage to or loss of clothing or other personal items of persons resulting from participation in the Activities.

8. CANCELLATIONS
a. You shall be entitled to cancel your booking subject to Aerial Adventures receiving your request for cancellation at least 24 hours before the booked start time. All cancellations and amendments must be made via email @ info.livingston@aerialadventures.co.uk. You shall be entitled to a full refund in the event of cancellation under this clause.
b. Aerial Adventures shall be entitled to cancel your booking at any time. In the event that Aerial Adventures decides to cancel your booking it shall use its reasonable endeavours to notify you as soon as possible. You shall be entitled to a full refund in the event of cancellation under this clause but no other compensation shall be payable.
c. In the event that it proves necessary to close the Activities for reasons beyond the control of Aerial Adventures and in circumstances where your party has commenced participation in the Activities, you shall not be entitled to any refund (in part or in whole). In such circumstances Aerial Adventures may, but shall not be obliged to, offer alternative dates or times at reduced rates.
9. PRICE AND PAYMENT
a. Subject to any terms agreed in writing between Aerial Adventures and you, our charges shall be calculated at our current rates and payment in full shall be due at the time of booking. The charges include the cost of purchasing the Activities.
10. REFUNDS AND AMENDMENTS
a. Payments made by debit or credit card will be refunded to the same card. Payments made by Gift Voucher will be refunded by the issuing of a replacement Gift Voucher to the same value.
11. LIABILITIES
a. Except as otherwise provided in these Booking Terms and Conditions Aerial Adventures shall not be responsible for the loss, or damage, of or to any property or to any person arising from the booking of or participation in the Activities.
b. Except as otherwise provided in these Booking Terms and Conditions any liability shall be limited to the refund of any charges paid to Aerial Adventures.
c. Nothing contained in these Booking Terms and Conditions is intended to nor shall limit the liability of Aerial Adventures in respect of death or personal injury caused by the negligence of Aerial Adventures or of its employees, agents or contractors.
12. MISCELLANEOUS
a. If any of these terms are determined to be illegal invalid or otherwise unenforceable it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and continue to be binding and enforceable.
b. Nothing above shall confer on any third party any benefit or the right to enforce any of these Booking Terms and Conditions.
c. These Booking Terms and Conditions shall be governed by and interpreted in accordance with the laws of Scotland and Aerial Adventures and you submit to the exclusive jurisdiction of the courts of Scotland.
13. INDOOR ADVENTURE SOFT PLAY
Soft Play Terms & Conditions Failure to adhere to the T&Cs may result in you being asked to leave the premise
a. All children must be accompanied and supervised by a responsible adult over the age of 18 at ALL times. Aerial Adventures does not accept responsibility for the supervision of children.
b. Buggies, Prams, Trolleys etc should be left in the area specified by staff when asked. This is to ensure no fire exits or escape routes can be blocked.
c. Parents / Guardians must ensure that children are appropriately dressed to use the facility. Please remove shoes before entering the play areas. Socks must be worn at all times. We advise that children should wear long trousers and sleeves to minimise the risk of “burn” and should not wear jewellery, buckles, watches or other sharp objects. Clothes should be tucked in.
d. We encourage parents or other accompanying adults to play with their children and to use the equipment where it is safe to do so. All adults doing this must use reasonable care to avoid damage to the equipment or injury to themselves or others
e. The baby area (in the corner to the left of the entrance) is for children aged 3 and under. Any older children found playing in this area will be asked to move to the larger area. This is for the safety of all children.
f. Balls and objects must not be thrown at others. Children must not be allowed to climb on the netted walls or the system structure or on the slides. Please also ensure that your children do not play directly in front of the slide exits.
g. NO food or drink can be consumed on our premises unless purchased on our premises. NO food or drink should be taken into the play frame. Chewing gum is strictly forbidden.
h. All children should use the toilet and wash their hands prior to entering the soft play area - any children who are not fully potty trained should be regularly taken to the toilet to minimise the risk of accidents within the soft play area. This is for the hygiene and safety of all children.
i. In the interests of Health and Safety, please ensure that any food debris which falls on the floor is picked/wiped up as soon as possible.
j. Please report any spillages/accidents to a member of staff immediately, to ensure that we can provide any necessary assistance and minimise the potential of re-occurrence. These will be logged and are an important part of on-going safety audits
k. Aerial Adventures staff have the right to refuse entry or request you to leave the premises due to any indecent or threatening behaviour or due to breaking the rules set out here.
l. No photographs/videos may be taken in the soft play area - this is to comply with the Child Protection Act Scotland.
m. The lift to the soft play area is for buggies & disabled access only. Please do not allow children to play in the lift.
n. Any concerns or issues relating to the soft play rules should be reported to a member of staff immediately.
No refunds can be given on the day, bookings need at least 24 hours notice of cancellation to be eligible for a refund.
o. All cancellations and amendments must be made via email @ info.livingston@aerialadventures.co.uk. with at least 24 hours notice.
